As a good renter, the renter has to take good care of the car, has to keep the car in good and same state in accordance with the description of the rental agreement, and has to deliver the car at the end of the rental to the agreed place and time, with all attachments, including the keys, vehicle registration documents and other documents.

The renter is not allowed in any case to make use of the following:

Towing a vehicle or a trailer, participating in races and / or rallies, the use of the car in an area where no paved roads are built (for example: Boka Tabla, Hato high plateau), the use by a driver who is not named as the renter or driver in the rental agreement.

Defects will be reported to RW Rental. RW Rental determines in that case, how and by whom the deficiencies will be remedied. If the deficiencies are not notified immediately after the beginning of the rental to RW Rental, it will be presumed that the renter has caused the defects and the repair for the damage will be charged to the renter by RW Rental.

Punctures or damage to tires in all cases are directly in charge of the renter, as it depends directly on the driving behavior of the driver. This is not covered by insurance.

In case of an accident: Do not move the vehicle. The renter must immediately call Curaçao Road Services “CRS” to the phone number 199 and also let the call Curaçao Road Services “CRS” make a report about the accident.

Also in connection with the insurance policy, the renter is obligated:

– To notify RW Rental as soon as possible in case of any accident:

– To abstain from admitting guilt in any form whatsoever;

– To leave the car behind only when the car is adequately safeguarded against accident, theft and burglary;

If the requirements are not followed as described above, the renter shall, in addition to possible compensation, pay a fee for extra administrative costs.

If there is negligence on behalf of the renter, the damage will be the sole responsibility of the renter.

Theft, embezzlement or misappropriation and seizure of the car must be reported immediately by the renter to RW Rental. In case of theft, embezzlement or misappropriation, the renter is obligated to file a report with the police within 24 hours of the theft, embezzlement or misappropriation, and immediately after making the report, to provide a copy of the declaration of police report to RW Rental.

Damages incurred by driving under the influence of alcohol and / or drugs is the sole responsibility of the renter.

If the car is not fully tanked by the renter when the car is returned at the end of the rental, RW Rental is entitled to completely fill up the car on the expense of the renter. RW Rental will also charge a fee to the renter if it is needed to refuel the car.

Renter must close (lock) the car properly at its non-use. In addition, the renter should at all times have sight to ensure that the car has sufficient oil and coolant, and the tire pressure is correct. The renter is fully responsible for refueling the car suitable fuel. Costs of any maintenance will be borne by RW Rental.

Liability of the renter

The renter is liable for all damages resulting from the violation of the preceding provisions, as well as for all the acts and omissions of the driver, passengers and all others who are in the car. The renter is liable for all costs, fines and other measures related to violation of any law, plus a fee for administration or third parties (at the rates charged by third parties). If the renter does not deliver the car in good condition on the date that has been agreed, with all the keys, documents and other items, RW Rental is entitled to charge the rent of the car, until all items have been delivered to RW Rental. Such a non-return is considered embezzlement and gives RW Rental the right to make declarations.

Obligations and liabilities of RW Rental

RW Rental is obligated to fix defects, if and insofar has knowledge or is ought to know about the defects at inception of the rental. The renter should inspect the car at the start of the rental. RW Rental is only obligated to take complaints about the condition of the car at the start of the rental in treatment that have been expressed directly by the renter at the beginning of the rental at RW Rental.

RW Rental ensures that the car has liability insurance. The renter’s issues are not insured.

Payment

If the car is not delivered in a good condition on the agreed date, with all the keys, documents and other items, RW Rental is entitled to charge the deposit of the car until all items have been delivered to RW Rental. In case of loss or theft, embezzlement or misappropriation the renter owes the deposit to RW Rental in addition to the obligation to pay full compensation in a case where the tenant alone is responsible.

Termination

RW Rental is entitled to terminate the rental agreement without notification or legal intervention in writing, including the following cases:

a. Attributable failure of the renter to fulfill its obligations;

b. Death or placement under guardianship of the renter;

Personal Data Protection

RW Rental stores and uses personal data of the renter for the execution of the agreement and for the fulfillment of legal obligations.

If the renter has committed (or is suspected of) any offenses, his/her data will be transmitted in the RW Rental warning system.

Definitions and conclusion of agreement

In case of renewal of the rental, all terms of the agreement remain into force, unless otherwise agreed in writing between the parties.
